1.About these Terms

1.1 These Terms and Conditions (‘Terms’) govern:

(a) Your access to and use of the website at www.wanderdeck.com.au (Website);

(b) Your access to and use of hiking information, digital content, member content, QR-linked pages, trail information and other online features made available through the Website (‘Online Content’); and

(c) The purchase of physical Wanderdeck card decks and any other products offered for sale through the Website (‘Products’).

1.2 The Website and Products are operated and supplied by Wanderdeck ABN 19 753 186 764 (Wanderdeck, we, us or our).

1.3 By accessing or using the Website, creating an account or purchasing a Product, you agree to be bound by these Terms.

1.4 If you do not agree to these Terms, you must not use the Website or Online Content.

1.5 You must be at least 18 years old to place an order through the Website, or otherwise have the consent and supervision of a parent or legal guardian.

1.6 In these Terms, Hiking Information means any information concerning hiking, bushwalking, trails, routes, locations, access, directions, parking, distances, estimated durations, difficulty, elevation, terrain, facilities, conditions, hazards, maps, navigation or other outdoor activities provided by Wanderdeck, whether:

(a) Printed on or supplied with a Product, including on a physical card, card deck, box, sleeve, packaging or insert;

(b) made available through the Website or Online Content; or

2.Other policies and the Hiking Disclaimer

2.1 These Terms are to be read together with:

(a) our Nature, Safety and Outdoor Disclaimer available on the Website (Hiking Disclaimer);

(b) our Privacy Policy;

(d) any terms expressly disclosed to you during checkout.

2.2 The Hiking Disclaimer applies whenever you use or rely on Hiking Information, including Hiking Information printed on or supplied with a Product or accessed through the Website or a QR-linked page.

2.3 The Hiking Disclaimer forms part of these Terms for each person who is bound by these Terms. The Hiking Disclaimer also contains important safety warnings intended to be read and observed by any person using a Product or Hiking Information, including a person who did not personally purchase the Product.

2.4 These Terms principally govern use of the Website, Online Content and the purchase of Products. The Hiking Disclaimer contains the more specific terms relating to outdoor safety and participation in hiking and other outdoor activities.

2.5 If there is any inconsistency:

(a) any law which cannot lawfully be excluded or modified prevails;

(b) product-specific terms displayed to you before purchase prevail in relation to that Product;

(c) the Hiking Disclaimer prevails in relation to hiking, outdoor safety and the risks associated with outdoor activities,

otherwise, these Terms prevail.

3.Nature of Wanderdeck

3.1 Wanderdeck provides Products and general information intended to assist users to discover and plan hiking and outdoor experiences.

3.2 Wanderdeck is not:

(a) a hiking or tour operator;

(b) a guide or outdoor recreation provider accompanying you on a hike;

(d) a provider of medical, health, fitness or survival advice; or

(e) responsible for supervising your participation in any activity.

3.3 Purchasing a Product or accessing the Website does not create a relationship of guide and participant, adviser and client or any other professional advisory relationship between you and Wanderdeck.

4.Hiking and outdoor information

4.1 Hiking Information may include information concerning:

(a) hike locations and trailheads;

(b) directions and parking;

(d) difficulty ratings;

(e) elevation or terrain;

(f) accessibility;

(g) facilities;

(h) seasonal considerations;

(i) waterfalls, lookouts and other natural features;

(j) nearby activities, accommodation or businesses;

(k) maps and links to mapping services; and

(l) other information intended to assist with planning an outing.

4.2 Hiking Information is provided for general informational, recreational and trip-planning purposes only.

4.3 Hiking environments are inherently variable. Tracks, access roads, facilities, river crossings, waterfalls, vegetation, weather, terrain, signage, closures, hazards and access arrangements can change after Hiking Information is prepared, published or printed.

4.4 Although we take reasonable care in preparing Hiking Information, to the maximum extent permitted by law we do not represent or warrant that any Hiking Information will at all times be:

(a) current;

(b) complete;

(d) suitable for your individual circumstances;

(e) consistent with current track conditions;

(f) available or legally accessible; or

(g) safe to undertake.

4.5 Distance, time and difficulty ratings are estimates only. Individual experience may differ depending on fitness, experience, weather, track conditions, pace, equipment and other circumstances.

5.Your responsibility to verify information

5.1 Wanderdeck Products and Hiking Information are intended to assist with planning. They must not be used as your sole source of navigation, safety, trail-condition or access information.

5.2 Before commencing a hike, you are responsible for independently checking current information from appropriate official sources, including where relevant:

(a) national park and conservation authorities;

(b) State or Territory parks and wildlife authorities;

(d) the Bureau of Meteorology;

(e) emergency services;

(f) road and transport authorities;

(g) rangers and visitor information centres; and

(h) signage, notices and directions at the location.

5.3 You must comply with all current laws, closures, warnings, permit requirements, directions and signage affecting an area.

5.4 You are responsible for determining whether a hike or other activity is appropriate for you and anyone accompanying you, including having regard to fitness, experience, age, health, weather, equipment and current conditions.

5.5 The additional responsibilities and risk acknowledgements in the Hiking Disclaimer also apply.

6.Third-party maps and mapping services

6.1 The Website and Products may provide links or access to maps, routes, directions or other information supplied through third-party mapping or navigation services, including services such as AllTrails.

6.2 Unless expressly stated otherwise, Wanderdeck does not create, control or independently verify all information displayed by a third-party mapping provider.

6.3 Maps, GPS routes, route lines, distances, directions and location information may contain errors or may not reflect current track conditions, closures, private property boundaries or other restrictions.

6.4 You must not rely solely on a third-party digital map or GPS route for navigation or safety.

6.5 Your use of a third-party mapping service is also subject to that provider's own terms, privacy policy and conditions of use.

6.6 The inclusion of a link to a third-party mapping service does not of itself mean that Wanderdeck is affiliated with, sponsored by or endorsed by that provider.

7.Third-party websites, businesses and services

7.1 The Website or Online Content may refer or link to third-party websites, accommodation providers, cafés, restaurants, tourism operators, businesses, attractions, transport providers or other services.

7.2 Unless expressly stated otherwise, those third parties are independent of Wanderdeck.

7.3 We do not control and are not responsible for the operation, availability, pricing, safety, accuracy, products, services, privacy practices or content of a third-party website or business.

7.4 You are responsible for making your own enquiries before acquiring goods or services from a third party.

7.5 A reference or link does not constitute a guarantee or endorsement of a third party unless we expressly state otherwise.

7.6 Third-party content made available through the Website may be subject to the relevant third party's own terms, copyright notices and conditions of use. These Terms do not grant you any right to use third-party content except to the extent we are authorised to grant that right or the use is otherwise permitted by law.

8.Intellectual property

8.1 Unless otherwise indicated, all intellectual property rights in or relating to Wanderdeck, the Website, the Products and the Online Content are owned by or licensed to Wanderdeck.

8.2 This includes rights in:

(a)the Wanderdeck name and branding;

(b) logos;

(d) photographs and illustrations;

(e) written hike descriptions and trail notes;

(f) graphics and layouts;

(g) curated content and compilations;

(h)QR-linked content;

(i) member-only content;

(j) milestone materials;

(k)Website design and functionality; and

(l)other original material created for Wanderdeck.

8.3 Third-party maps, photographs, trademarks and other third-party content remain the property of their respective owners.

8.4 Subject to these Terms, we grant you a limited, revocable, non-exclusive and non-transferable licence to access and use the Website and Online Content for your own personal and non-commercial use.

8.5 You may make reasonable personal use of information for the purpose of planning and undertaking your own hikes.

8.6 You must not, without our prior written consent:

(a) reproduce, republish, distribute or commercially exploit any substantial part of our Website, Products or Online Content;

(b) reproduce Wanderdeck cards or create copies or derivative card decks;

(d) scrape, systematically extract or compile Website content into another database, website, application, guide or product;

(e) use Wanderdeck content to provide a commercial hiking, guiding, tourism or competing information service;

(f) remove or alter any copyright, trademark or proprietary notice; or

(g) use the Wanderdeck name, logo or branding in a manner which suggests an association, sponsorship or endorsement that does not exist.

8.7 Nothing in these Terms prevents any use which is permitted by law and cannot lawfully be restricted by contract.

9.Acceptable use of the Website

9.1 You must not use the Website:

(a) unlawfully or fraudulently;

(b) to interfere with the Website's security or operation;

(d) to obtain unauthorised access to another person's account;

(e) to harvest personal information;

(f) using automated tools to scrape or systematically extract protected content; or

(g) in a manner which infringes our rights or the rights of another person.

9.2 We may take reasonable steps to restrict or suspend access where we reasonably believe there has been a material breach of this clause, misuse of an account, unlawful activity or a security risk.

10.Accounts and digital access

10.1 Some Website features may require you to create an account.

10.2 You must provide accurate information and keep your login credentials secure.

10.3 You are responsible for activity occurring through your account to the extent it results from your failure to take reasonable steps to protect your login credentials.

10.4 Member-only and QR-linked content is provided for personal use and must not be copied or shared for the purpose of allowing persons who are not entitled to access that content to circumvent Wanderdeck's access controls.

10.5 We may suspend or restrict an account where we reasonably believe:

(a) there has been a material breach of these Terms;

(b) an account is being used fraudulently;

(d)Wanderdeck content is being unlawfully copied or distributed; or

(e) suspension is reasonably necessary for security, maintenance or legal compliance.

10.6 We will not exercise a right under this clause in a way which unlawfully removes rights or services for which you have paid.

11.Milestone rewards

11.1 Certain Products may include access to hike logging and milestone rewards.

11.2 Eligibility requirements and the rewards available will be described on the Website from time to time.

11.3 Unless otherwise stated, milestone rewards:

(a) require a genuine qualifying Product purchase;

(b) require the qualifying hikes to be recorded through the relevant Wanderdeck account;

(d) are not redeemable for cash; and

(e) are subject to reasonable verification to prevent fraud or misuse.

11.4 Where a particular reward is expressly included as part of a Product at the time of purchase, we will honour that offer subject to these Terms and applicable law.

11.5 If a particular physical reward becomes unavailable, we may substitute a reward of reasonably comparable or greater value.

11.6 We may change the structure of the milestone program for future purchases and may make reasonable changes for existing users where required because of stock availability, legal requirements, security, fraud prevention or operational necessity, provided that we do not exclude any right which you have under the Australian Consumer Law.

12.Website and Online Content availability

12.1 We aim to keep the Website and Online Content reasonably available but do not guarantee uninterrupted or error-free access.

12.2 The Website or particular features may be temporarily unavailable for maintenance, security, updates, technical failures or circumstances outside our reasonable control.

12.3 We may update Online Content when new information becomes available.

12.4 We may modify or discontinue free Website features where reasonably necessary for operational, technical, security or legal reasons.

12.5 If a digital feature formed a material part of a Product or service purchased by you, any material change to that feature remains subject to your rights under applicable law, including the Australian Consumer Law.

12.6 To the maximum extent permitted by law, we do not warrant that the Website, Online Content or any linked content will be free from viruses, malicious code or other harmful components. You are responsible for implementing reasonable safeguards appropriate to your device and systems.

13.Products and product descriptions

13.1 We take reasonable care to ensure Product descriptions, photographs and pricing are accurate.

13.2 Images are illustrative and the appearance of colours and printed Products may vary slightly depending on screen settings, printing processes and manufacturing tolerances.

13.3 Nothing in clause 13.2 permits a Product to materially differ from its description or affects any guarantee applying under the Australian Consumer Law.

13.4 Product availability is subject to stock.

13.5 Because physical Products contain printed information, information printed on a Product reflects information available when that information was prepared for publication and cannot be updated after the Product has been printed. Tracks, access, closures, facilities, hazards, conditions and other information may subsequently change. Before undertaking an activity, you must check current information in accordance with clause 5 and the Hiking Disclaimer.

14.Orders

14.1 By submitting an order, you offer to purchase the Products in your order for the total amount shown at checkout.

14.2 You must ensure the information provided with your order is complete and accurate.

14.3 An automated acknowledgement that we have received your order does not necessarily constitute acceptance of that order.

14.4 We may decline an order before acceptance where reasonably necessary, including because:

(a)a Product is unavailable;

(b) we cannot deliver to the nominated address;

(d) payment has not been authorised; or

(e) we reasonably suspect fraud or unauthorised payment activity.

14.5 If payment has been taken for an order which we do not accept, we will refund the amount paid.

14.6 A contract for the sale of the Products is formed when we confirm acceptance of your order or dispatch the Products, whichever occurs first.

15.Prices and payment

15.1 Unless otherwise stated:

(a) all prices displayed on the Website are in Australian dollars;

(b) prices include any taxes required to be included in the displayed price; and

15.2 You must pay the total amount shown at checkout when submitting your order unless another payment arrangement is expressly offered.

15.3 Payments may be processed by third-party payment providers. Your use of a third-party payment service may also be subject to that provider's terms and privacy policy.

15.4 If an obvious and genuine pricing error occurs, we may contact you before accepting the order and give you the option to proceed at the correct price or cancel the order for a full refund.

16.Pre-orders

16.1 A Product described as a pre-order, presale or similar may not be available for immediate dispatch.

16.2 Any production, availability or dispatch date stated for a pre-order is an estimate unless expressly stated to be a guaranteed date.

16.3 We will take reasonable steps to notify you if there is a material delay.

16.4 Unless otherwise stated on the Product page, a pre-order is not refundable merely because you change your mind.

16.5 Clause 16.4 does not affect your rights where:

(a) we fail to supply the Product within an agreed or reasonable time;

(b) the Product does not comply with a consumer guarantee; or

17.Delivery

17.1 We deliver to the locations made available through our checkout.

17.2 Delivery charges and any estimated delivery timeframe will be displayed at checkout or otherwise communicated to you.

17.3 Delivery timeframes are estimates only unless we expressly agree to a particular delivery date.

17.4 You must provide a complete and accurate delivery address.

17.5 We may pass your name, contact details and delivery address to a delivery provider to fulfil your order in accordance with our Privacy Policy.

17.6 Where you expressly authorise a carrier to leave an order unattended at a nominated location, you accept the ordinary risks associated with that authority to the extent the loss or damage results from the order being left in accordance with your instructions.

17.7 If an order is returned because you provided an incorrect or incomplete address, or failed to collect the parcel after reasonable notification, we may require payment of reasonable additional delivery costs before resending it, except where the failure was caused by us or our delivery provider.

17.8 If your order is lost, materially delayed or damaged in transit, please contact us. We will investigate the matter with the carrier and provide any remedy required under applicable law.

18.Change of mind returns

18.1 Unless a Product page expressly provides otherwise, Wanderdeck does not offer refunds or exchanges merely because you:

(a) change your mind;

(b) no longer want the Product;

(d) find the Product elsewhere for a lower price.

18.2 Nothing in this clause affects your rights under the Australian Consumer Law.

19.Faulty, damaged or incorrectly supplied Products

19.1 Our Products come with guarantees that cannot be excluded under the Australian Consumer Law.

19.2 Depending on the circumstances, those guarantees may include that Products:

(a) are of acceptable quality;

(b) are fit for any purpose made known to us before purchase; and

19.3 If you believe a Product is faulty, damaged, defective or incorrectly supplied, please contact us at info@wanderdeck.com.au with:

(a) your order number or other proof of purchase;

(b) a description of the issue; and

19.4 For damage which appears to have occurred during delivery, we ask that you contact us as soon as reasonably practicable and preferably within five days so that we can promptly investigate the issue with the delivery provider.

19.5 The timeframe in clause 19.4 is an administrative request only. It does not limit or exclude any right you may have under the Australian Consumer Law.

19.6 Where a Product fails to comply with a consumer guarantee, the remedy available will depend on the nature and seriousness of the failure and may include repair, replacement, refund or another remedy available under the Australian Consumer Law.

19.7 We may reasonably require the Product to be returned or otherwise assessed before providing a remedy.

19.8 If a Product is confirmed to have a problem covered by the Australian Consumer Law, we will reimburse reasonable return postage costs where required by law.

19.9 You do not need to return a faulty Product in its original packaging in order to exercise a right under the Australian Consumer Law.

20.Hiking risks and liability

20.1 Hiking, bushwalking and outdoor recreation may involve inherent and potentially serious risks, including risks arising from:

(a) cliffs, steep terrain and unstable surfaces;

(b) waterfalls, rivers, creeks and flooding;

(d) extreme heat, cold, storms and rapidly changing weather;

(e) fire and smoke;

(f) wildlife, insects and vegetation;

(g) falling trees or rocks;

(h) remoteness and limited communications;

(i) becoming lost or disoriented;

(j) track damage, closures and changed conditions; and

(k) your own health, fitness, preparation, decisions or conduct.

20.2 The Hiking Disclaimer contains additional important information concerning those risks and must be read before using or relying on a Product or Hiking Information to plan or undertake an outdoor activity.

20.3 To the maximum extent permitted by law, Wanderdeck is not responsible for loss, injury or damage caused by:

(a) your decision to participate in a particular outdoor activity;

(b) your failure to check current official information, warnings or closures;

(d) conditions which changed after Wanderdeck information was prepared;

(e) inaccuracies in information supplied by an independent third party; or

(f) conduct or circumstances outside Wanderdeck's reasonable control,

except to the extent that the loss, injury or damage was caused by Wanderdeck's breach of a right or obligation which cannot lawfully be excluded or limited.

21.Australian Consumer Law

21.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable law, where it would be unlawful to do so.

21.2 Any exclusion or limitation of liability in these Terms applies only to the maximum extent permitted by law.

21.3 If any service supplied by Wanderdeck is legally characterised as a recreational service for which liability may lawfully be excluded or limited, any exclusion or limitation applies only to the extent permitted by applicable legislation.

22.Limitation of liability

22.1 Subject to clause 21 and to the maximum extent permitted by law, Wanderdeck is not liable for loss or damage to the extent caused by:

(a) your misuse of the Website, Online Content or Products;

(b) your breach of these Terms or the Hiking Disclaimer;

(d) an act or omission of an independent third party;

(e) inaccurate information supplied by a third party which Wanderdeck reasonably relied upon;

(f) telecommunications, internet, GPS or mapping service failures outside our reasonable control; or

(g) events outside our reasonable control.

22.2 To the maximum extent permitted by law, Wanderdeck is not liable for indirect or consequential loss which was not reasonably foreseeable as a result of Wanderdeck's breach.

22.3 Clauses 20 to 22 do not exclude liability to the extent that it cannot lawfully be excluded or limited.

23.Privacy

23.1 We handle personal information in accordance with our Privacy Policy.

23.2 By providing information through the Website, you acknowledge that it may be used for purposes reasonably necessary to provide the Website, fulfil orders, administer accounts and milestone rewards, communicate with you and otherwise operate Wanderdeck in accordance with our Privacy Policy and applicable law.

24.Changes to these Terms

24.1 We may amend these Terms from time to time where reasonably necessary to reflect:

(a) changes to the Website or Products;

(b) legal or regulatory requirements;

(d) security requirements; or

(e) reasonable changes to the way Wanderdeck operates.

24.2 The current version will be published on the Website together with the date it was last updated.

24.3 Amendments apply prospectively to your use of the Website after the amended Terms take effect.

24.4 Unless required by law or agreed with you, an amendment will not retrospectively change the terms applying to an order already accepted by us.

25.Severability

25.1 If any provision of these Terms is invalid, unlawful or unenforceable, that provision is to be read down to the extent necessary to make it valid and enforceable.

25.2 If it cannot be read down, it is severed and the remaining provisions continue to apply.

26.No waiver

A failure or delay by Wanderdeck in exercising a right under these Terms does not waive that right.

27.Governing law

27.1 These Terms are governed by the laws applying in Queensland, Australia and the applicable laws of the Commonwealth of Australia.

27.2 Subject to any right you have under applicable law to bring proceedings in another jurisdiction, the parties submit to the courts of Queensland and any courts entitled to hear appeals from those courts.

28.User content and submissions

28.1 If you submit content to the Website in a form intended to be published, displayed or shared through the Website (User Content), you grant Wanderdeck an irrevocable, non-exclusive, royalty-free and perpetual licence to use, reproduce and publish that User Content on or in connection with the Website and Wanderdeck.

28.2 You warrant that you have all necessary rights, permissions and licences to submit the User Content, that the User Content is not defamatory, does not infringe the rights of any third party and does not breach any applicable law.

28.3 To the extent permitted by law, you consent to Wanderdeck doing any act in relation to the User Content that would otherwise infringe your moral rights, to the extent reasonably necessary for Wanderdeck to use and publish the User Content in accordance with these Terms.

28.4 To the extent permitted by law, you indemnify Wanderdeck and its officers, employees and agents against any third-party claim, loss, liability or reasonable expense arising from your breach of the warranty in this clause.

Nature, Safety & Outdoor Disclaimer

This disclaimer applies to hiking, trail and outdoor information provided by Wanderdeck ABN 19 753 186 764 (Wanderdeck, we, us or our), including information printed on Wanderdeck cards, card decks, packaging and inserts and information available through our website, QR-linked pages or other digital content (Hiking Information).

1. General information only

1.1 Wanderdeck provides Hiking Information as a general recreational and trip-planning resource.

1.2 Wanderdeck is not a hiking or tour operator, does not accompany or supervise you on a hike, and does not operate, control or maintain the trails, parks, roads, facilities or locations referred to in our Hiking Information.

1.3 Hiking Information is not professional safety, navigation, medical, health, fitness or survival advice.

2. Information and conditions can change

2.1 Outdoor environments and access arrangements can change quickly.

2.2 Tracks, roads, parking, facilities, river and creek crossings, weather, vegetation, signage, permits, closures, fire conditions, flooding, hazards and access restrictions may change after Hiking Information has been prepared.

2.3 In particular, information printed on a physical Wanderdeck card reflects information available when the card was prepared for printing and cannot be updated after printing.

2.4 Accordingly, we cannot guarantee that Hiking Information will always be current, complete, accurate or suitable for the conditions that exist when you undertake a hike.

3. Check current official information

3.1 Before commencing any hike or outdoor activity, you should independently check current information from appropriate official sources, including relevant parks or conservation authorities, local councils, the Bureau of Meteorology, emergency or fire authorities, road authorities, visitor information centres and local signage or notices.

3.2 Current official warnings, closures, directions and signage should always be followed where they differ from information supplied by Wanderdeck.

3.3 Do not rely on a Wanderdeck card, QR-linked page, map or third-party mapping service as your sole source of navigation, safety or trail-condition information.

4. Hiking involves risk

4.1 Hiking, bushwalking and outdoor recreation involve inherent risks which may result in serious injury or death.

4.2 Depending on the location and conditions, risks may include cliffs and steep terrain, slippery or unstable surfaces, waterfalls, rivers, creek crossings, flooding, extreme heat or cold, storms, fire and smoke, wildlife, insects, vegetation, falling trees or rocks, becoming lost, limited communications, remoteness, track damage and changing conditions.

4.3 You are responsible for taking reasonable precautions appropriate to the activity you undertake.

5. Your circumstances and preparation

5.1 You are responsible for deciding whether a particular hike or outdoor activity is appropriate for you and anyone accompanying you.

5.2 You should take into account matters including fitness, health, age, experience, weather, track conditions, equipment, clothing, water, food, navigation, communications and the capabilities of members of your group.

5.3 Distance, duration and difficulty ratings supplied by Wanderdeck are estimates only. Your experience may differ depending on conditions, fitness, pace, experience and other circumstances.

6. Maps and third-party information

6.1 Wanderdeck may refer or link to maps, directions, routes or other information supplied by independent third parties.

6.2 Unless expressly stated otherwise, Wanderdeck does not control those providers and does not independently verify every map, GPS route, direction or item of information they provide.

6.3 Digital maps and GPS information may contain errors and may not show current closures, track changes, private property, hazards or access restrictions.

7. Responsibility and liability

7.1 To the maximum extent permitted by law, Wanderdeck is not responsible for loss, injury or damage to the extent caused by:

your decision to undertake a particular hike or outdoor activity;

your failure to check current official information, weather, warnings, closures or conditions;

your failure to follow applicable laws, signage, warnings or directions;

conditions which changed after the relevant Hiking Information was prepared or printed;

inaccurate or incomplete information supplied by an independent third party;

your health, fitness, experience, preparation, equipment, decisions or conduct; or

circumstances outside Wanderdeck's reasonable control.
